Welcome to Cignition.Cignition, Inc. (“Cignition,” “we,” “our,” or “us”) is education company that provides online tutorial services for K-12 students throughout the United States. We provide our services through two primary channels: (1) as a service provider to local educational agencies (“LEAs”) and school districts pursuant to written agreements with such entities, and (2) directly to parents and legal guardians who purchase our services for their K-12 students. Our services are delivered through our website at Cignition.com and our related educational platform at FogStoneIsle.com (the “Platform”), which is used exclusively to provide educational services to students. Please carefully read this Privacy Policy (“Privacy Policy”) before participating in Site activities or using any Cignition application. This Privacy Policy applies to information collected as part of using our websites, mobile applications, the Platform, and any other information we collect. We refer to the places we collect information generally as the “Site.” The “Site” includes by definition, our websites (including Cignition.com and FogStoneIsle.com), interactive features, applications, the Platform, or other online or wireless offerings that post a link to this Privacy Policy, whether accessed via computer, mobile device, or other technology, manner, or means.
Your use of this Site constitutes acceptance of this Privacy Policy, our Terms of Service (the “Terms”), and any other policies, agreements, terms and conditions contained on the Site. We reserve all rights to modify, delete, or append portions of this Privacy Policy, the Terms, and any other terms and conditions at our sole discretion. We will provide notice of any change by changing the “Last updated” date above, by sending emails, and/or by other methods intended to notify you of any changes. We recommend you review this Privacy Policy from time to time during visits to this Site.

2. Personal Information Collection
We collect information primarily when voluntarily provided to us by you to participate in and use our applications. If you would like to review any of the information we have in our systems about you or your student, please contact us using the contact information in this Privacy Policy. When anyone uses our applications, products, or services, we collect information around that use. When we provide services through a LEA or school district, we receive student information as directed by and on behalf of the LEA or school district pursuant to our written agreement with such entity. In such cases, the LEA or school district determines what student information is shared with us, and we act as a service provider processing that information solely to provide the contracted educational services. When parents or legal guardians purchase our services directly, adults (including but not limited to parents and legal guardians) may provide us with voluntarily supplied personally identifiable information upon registration. Students may, at the time of registration, create a user name, and our system creates an electronic persistent identifier for each student associated with that user name. While parents, legal guardians, and/or teachers may have access to student user names to track student performance and results, and the system can utilize the persistent identifier to modify gameplay to adjust to the student’s ability level, our systems are designed to minimize the collection of student personal information. We may use information in our systems in an anonymous and aggregated manner to measure all students’ performance to improve our applications, products, and services.
Account Creation:
To access and use certain features of our services, you may be required to create an account. The information we collect during account creation depends on how you access our services:
Parent and Guardian Accounts: When parents or legal guardians purchase our services directly or create an account on Cignition.com, we may collect your name, email address, phone number, billing and payment information, and information about your student (such as your student’s first name, grade level, and learning needs). You are responsible for the accuracy of the information you provide.
Student Accounts: Student accounts on the FogStoneIsle.com platform are created by a parent, legal guardian, or LEA/school district. Students do not create their own accounts independently. During the account setup process, a user name is created for the student, and our system generates an electronic persistent identifier associated with that user name to enable the Platform to adjust to the student’s ability level. We minimize the collection of student personal information during the account creation process.
We use the information collected during account creation solely to set up and maintain your account, provide our educational services, communicate with you about your account or your student’s progress, and as otherwise described in this Privacy Policy. We do not use account creation information for any purpose unrelated to providing our services.
Google Account Login:
Our Site allows users to log in using their Google account credentials through Google’s authentication service (commonly known as “Sign in with Google” or Google Single Sign-On). When you choose to log in via Google, we may receive certain information from your Google account profile, such as your name, email address, and profile picture, as permitted by your Google account settings. We use this information solely for the purpose of authenticating your identity and creating or linking your Cignition account. We do not receive or store your Google password. We use this information solely to create or link your account with us, verify your identify, and provide you with access to our services. We , and we do not request or receive access to your Google Drive, Gmail, or other Google services beyond what is necessary for authentication. Your use of Google’s authentication service is also subject to Google Privacy Policy and Terms of Service. Google login is available on both Cignition.com and the FogStoneIsle.com platform for parent access.
Chatbot/AI Interactions:
Our Cignition.com website features an automated chatbot that is designed to answer frequently asked questions about Cignition’s services, provide information about our tutoring programs, assist prospective tutors, offer technical support guidance, and provide guided tours of our website. When you interact withour chatbot, we collect and process the content of your conversation with the chatbot, your IP address and device information, and the date and time of your interaction. The chatbot is intended for general informational purposes only and is not directed at students or children. We do not use information collected through the chatbot for targeted advertising or any purpose unrelated to responding to your inquiry and improving our services. Our chatbot is available only on Cignition.com and is not present on the FogStoneIsle.com platform.
Cookies and Pixel Tags:
We use standard technologies such as a “cookie” and pixel tags to collect information about how the Site is used. A cookie is a small removable data file that is stored by your web browser on your computer. We use cookies to, among other things, identify your computer during a particular session, i.e., when you sign into the Site, and analyze Site visitor behavior. Cookies enable you to store your password for fast logon and other conveniences. We do not store personal or sensitive information in cookies. Pixel tags, also known as beacons or Clear GIF’s, are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of users. In contrast to cookies, which are stored on a user’s computer hard drive, pixel tags are embedded invisibly on web pages.
You can manage or delete cookies through your web browser settings. Most browsers allow you to refuse or accept cookies, delete existing cookies, and set preferences for certain websites. Please note that if you choose to disable cookies, some features of the Site may not function properly.
IP Addresses:
We collect and analyze traffic by keeping track of the IP addresses of our visitors. An IP address is the unique numeric identifier assigned to each browser accessing the Internet. An IP address, by itself, cannot identify you personally. However, when combined with other information provided by your Internet Service Provider (ISP), your IP address can be used to identify the computer originating a message
3. Opting Out of Cignition Applications
Cignition applications are customized for each student. All information we request is required to use Cignition applications. At any time, you may revoke your consent to allowing your student to use Cignition applications. If you do so, we will retain anonymous information, but your student will no longer be able to use Cignition applications. If your student accesses Cignition services through an LEA or school district, you may also be able to opt out of the school sharing information with us by contacting the applicable LEA or school district directly.
4. How We Use and Share Information
We use information only to provide and improve Cignition education applications, products, and services, and for no other commercial purposes. We do not share any information with anyone or any third party for commercial purposes or marketing purposes. We do not keep student personal information for longer than is necessary to provide our services. When our services are provided through an LEA or school district, we act as a service provider and process student data solely as directed by and on behalf of the LEA or school district, in accordance with our written agreement with such entity and applicable law. For more information about our student data practices, please see Section 9 (Student Data Privacy).
For tutoring services, we provide the student’s first name and other relevant information to the tutor for the tutor to provide tutoring services.
For the purpose of operating our business, we may transfer information to our service providers who may use that information only to conduct our business. For example, service providers may handle data management, e-mail distribution, market research, and information analysis. We provide our service providers with the information they need to perform their services and work with them to protect your information.
We reserve the right to share information in the following ways:
- Legal Disclosures; Safety: if it is necessary to investigate, prevent, or otherwise take action regarding suspected fraud, situations involving threats or potential harm, or if otherwise required by law (such as by a subpoena, court order, or other legal means).
- Violations of Terms and Policies: In the event that we reasonably believe that you have violated any of the terms or policies governing your use of the Site, we reserve the right to use any information we have collected about you in connection with any efforts we make or made by any of our agents on our behalf.
- Affiliates: We may share information with other entities affiliated with us for internal reasons, primarily for business and operational purposes including any corporate reorganization, restructuring, or other corporate change.
- Business Transactions: In addition, if we sell the company including the Site and any of our products and services, information may be one of the business assets we transfer. We reserve the right to disclose and transfer user information in connection with any activity and/or transaction described above; however, we will not contract with or transfer the company to a third party that will not agree to abide by the terms of this Privacy Policy, unless your consent is obtained.
Notwithstanding the foregoing, all student information will be retained and used for educational purposes only.
5. Security Measures
Information submitted via the Internet, including through a web page, e-mail, or mobile communications, is subject to interception or incorrect routing, and the Internet is not a fully secure communications channel. Please consider this prior to submitting any information to us.
While we follow generally accepted industry standards to protect the personal information submitted to us, no method of transmission over the Internet, or method of electronic storage, is perfectly secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
If we learn of a breach of our systems and that third parties have gained unauthorized access to any information in our systems, we will work with appropriate entities, law enforcement personnel, and other authorities, to determine if public or other notice is necessary or appropriate under the circumstances.
6. International Users
This Site is operated from the United States and is intended for and directed to users in the United States. If you choose to access the Site from outside the United, you do so on your own initiative, and you are responsible for complying with applicable local laws. We do not knowingly collect personal information from individuals outside the United States.
7. Unsubscribe / Contact Us
We want to communicate with you only if you want to hear from us. If you prefer not to receive information from us or would like to update or change your personal information or preferences, use the Contact Us information in this Privacy Policy. However, we may send you service-related announcements and transactional e-mail from time to time through the general operation of the Site or by e-mail. If you do not want to receive any e-mail from us in the future, click the “unsubscribe” reference in any e-mail we send you.
8. Children's Privacy - COPPA
Cignition is committed to protecting the privacy of children under 13 years of age in accordance with the Children’s Online Privacy Protection Act and the COPPA Rule as amended. Because our services are educational services for K-12 students, we maintain a separate Children’s Privacy Policy that provides detailed information about our practices regarding the collection, use, and disclosure of personal information from children, including the categories of information we collect, how we use and share that information, our data retention practices, how we use obtain verifiable parental consent, the rights of parents and legal guardians to review, delete, and refuse further collection of their child’s information and our information security practices. Our Children’s Privacy Policy is available here. We encourage all parents, legal guardians and LEAs to review our Children’s Privacy Policy carefully before allowing a child to use our services.
9. Student Data Privacy
Cignition is committed to protecting student data in compliance with applicable law. In connection with our educational services, we adhere to the following principles:
We do not use student personal information for targeted advertising or any commercial purpose unrelated to providing our educational services.
We do not sell student personal information or use it to create advertising profiles on students.
We will delete student information at the request of the applicable LEA or school district, or at the request of a parent or legal guardian for direct accounts, within a commercially reasonable timeframe.
We implement and maintain reasonable security procedures and practices appropriate to the nature of the student information we hold, designed to protect such information from unauthorized access, destruction, use, modification, or disclosure.
We do not disclose student personal information to third parties except as necessary to provide our educational services, as required by law, or as otherwise permitted under applicable law. Any service providers to whom we disclose student information are contractually required to use such information solely to provide services to or on behalf of Cignition and are prohibited from using student information for any other purpose.
When we provide services through an LEA or school district, the LEA or school district retains control over and ownership of student data, consistent with applicable law. We use student data only for the purposes set forth in our agreement with the LEA or school district, and we will not retain student data beyond the period authorized by the LEA or school district.
10. Google Analytics
Our Cignition.com website may use Google Analytics, a web analysis service provided by Google, in order to better understand your use of our website and how we can improve it. Google Analytics is NOT used on our FogStoneIsle.com platform. Google Analytics does not access to any student data. Google Analytics collects information such as how often users visit a website, what pages you visit when you do so, and what other websites you used prior to coming to such website. Google Analytics collects only the IP address assigned to you on the date you visit a website, rather than your name or other identifying information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit a website, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to our websites is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. Google utilizes the data collected to track and examine the use of our websites, to prepare reports on its activities and share them with other Google services. Google may use the data collected on the website to contextualize and personalize the ads of its own advertising network. 11. SMS Messaging
If you opt in to receive text messages from us, we collect your mobile phone number and the consent choices you make at sign-up. We use this information to send you the messages you have requested — for example, tutoring session reminders, scheduling confirmations, and, if you have opted in, follow-up messages after your free session.
We use a third-party SMS provider to deliver these messages. Your mobile number and message content are shared with that provider solely for the purpose of delivering texts to you. We do not sell or share your mobile number or SMS consent information with third parties for their own marketing purposes.
You can opt out of text messages at any time by replying STOP to any message you receive from us. You can get help by replying HELP or by contacting us at info@cignition.com. Message and data rates may apply. Message frequency varies.
If you opt out, we will retain a record of your opt-out request so that we can honor it going forward. We retain mobile numbers and related consent records for as long as you remain opted in, and for a reasonable period afterward to document compliance with applicable law.
Our text messages are directed solely to parents, legal guardians, and other authorized adult users. Cignition does not send text messages to students or collect mobile phone numbers from students. If you believe a student has provided a mobile phone number to Cignition, please contact us immediately using the information in Section 1.
12. Changes to this Policy
This Policy is current as of the effective date set forth above. We may change this Policy from time to time, so please be sure to check back periodically. We will post any updates to this Policy on this page. If we make material changes to how we collect, use, or disclose the personal information we have previously collected, we will endeavor to provide you prior notice as required by applicable law, such as by emailing you or posting prominent notice on our website.
